1. Introduction and subject matter of the agreement
(1) Santi Technologies UG (haftungsbeschränkt) (“NomadPost”) operates a peer-to-peer platform that connects senders (“Senders”) and travelers (“Carriers”) for the carriage of documents and items.
(2) Important notice: NomadPost does not itself provide postal, courier or transport services. The contract of carriage is concluded exclusively and directly between the Sender and the Carrier. NomadPost merely arranges the opportunity to make contact.
2. Conditions of use and verification
(1) Users must be at least 18 years old and have full legal capacity.
(2) Full access (booking/offering) requires identity verification (identity document and selfie) through our specialised identity verification service provider. NomadPost reserves the right to refuse or block users without stating reasons.
3. Sender obligations and prohibited contents
(1) The Sender warrants that the shipment does not contain prohibited items. The following are strictly prohibited:
- Illegal substances: drugs, narcotics, third parties’ prescription-only medicines, cannabis.
- Dangerous goods: weapons, ammunition, explosives, flammable liquids, batteries (unless built into the device).
- Currencies: cash, precious metals, securities.
- Sanctioned goods: items subject to embargoes or export restrictions (in particular EU sanctions relating to Russia/Belarus/Central Asia).
(2) The Sender is obliged to declare the contents of the shipment to the Carrier and the platform truthfully and in full.
(3) The above list of obligations and prohibitions is not exhaustive and may be expanded at any time in accordance with applicable legal provisions.
4. Carrier obligations and rights of inspection
(1) The Carrier is obliged to independently verify the applicable customs rules of transit countries and of the destination country.
(2) Duty to inspect: The Carrier is obliged to physically inspect the contents of the shipment before taking charge. The Carrier has the right to refuse to carry the shipment without stating reasons if the contents do not match the description or if there are safety concerns.
(3) The Carrier acts on its own responsibility. The Carrier is personally responsible for proper customs clearance (including compliance with duty-free allowances, etc.).
(4) The Carrier is strictly prohibited from using the platform or the handover and inspection process to falsely allege breaches by the Sender or to slip prohibited items to the Sender. Any manipulation of the shipment by the Carrier intended to discredit the Sender, extort the Sender or expose the Sender to official measures will result in immediate permanent blocking of the account and will be reported to the criminal authorities by NomadPost without exception. The Carrier is liable to the Sender and NomadPost for all resulting damage. The Carrier warrants that it holds all official permits and authorizations required for the transport (e.g. under goods road transport law, where applicable) and complies with weight limits for transport that does not require a permit.
(5) The above list of obligations is not exhaustive and may be expanded at any time in accordance with applicable legal provisions.
5. Sanctions compliance and disclaimer
(1) Sanctions prohibition: Use of the platform to circumvent trade restrictions, embargoes or sanctions (in particular EU, OFAC, UN) is strictly prohibited.
(2) Indemnity: NomadPost accepts no responsibility for breaches of customs or export control rules by users. Users indemnify NomadPost against all third-party claims (including from authorities) arising from non-compliant transport.
(3) If there is suspicion of criminal offences or sanctions breaches, NomadPost is entitled to transmit all relevant data to the competent criminal prosecution and customs authorities.
(4) Anti-money laundering: Use of the platform for money laundering or terrorist financing is strictly prohibited. Users may use payment processing only for legitimate brokerage fees and transport compensation within the described services. NomadPost works closely with the payment service provider Stripe to identify suspicious transaction patterns. We reserve the right, where there is suspicion of money laundering (e.g. unusually high payment amounts for very small shipments or frequent cancelled transactions), to freeze accounts and file reports with the competent financial authorities (e.g. FIU).
(5) The aforementioned prohibitions are not exhaustive and particularly also include other unlawful, abusive or fraudulent activities.
6. Payment processing and commission
(1) NomadPost charges a service fee (commission) for arranging the transaction. This is shown transparently to the user before the booking process is completed.
(2) Payment processing is handled via Stripe. The amount is managed technically through Stripe’s infrastructure and is paid out to the Carrier only after confirmed delivery (or expiry of a defined objection period). NomadPost never holds user funds in its own business accounts.
7. Limitation of liability of NomadPost
(1) NomadPost is not liable for loss, damage or delayed delivery of shipments or for the physical condition of the goods transported.
(2) NomadPost has unlimited liability for intent and gross negligence. For slight negligence, NomadPost is liable only for breach of an essential contractual obligation (cardinal obligation).
(3) The above limitations of liability do not apply to injury to life, body or health or to claims under product liability law.
8. Dispute resolution and mediation
(1) If there is a disagreement between Sender and Carrier, direct clarification should be attempted first.
(2) NomadPost may act as mediator on a voluntary basis but does not guarantee that an agreement will be reached.
(3) Users are obliged to report irregularities or suspicious activity without delay to info@nomadpost.de.
9. Particulars of the shopping service (purchase by the Carrier)
(1) Arrangement character: Where a Carrier offers to purchase goods abroad on behalf of the Sender (here: “Purchaser”) and subsequently transport them (“shopping service”), NomadPost acts solely as arranger of contact and payment processing.
(2) Purchase relationship: The contract of sale for the goods is concluded exclusively and directly between the Purchaser and the Carrier. The Carrier acts as reseller in its own name. NomadPost never becomes owner or seller of the goods.
(3) Disclaimer for defects of quality and title:
NomadPost gives no warranty and accepts no liability for the quality, fitness for purpose, authenticity or completeness of goods acquired by the Carrier.
All claims under purchase law (e.g. liability for defects, statutory cancellation or return) must be settled directly between the Purchaser and the Carrier.
NomadPost is not liable for price differences, mistaken purchases by the Carrier or unavailability of goods in the country of purchase.
(4) Customs and tax obligations on resale: Because the Carrier acquires the goods in its own name and resells them to the Purchaser, this constitutes commercial import. The Carrier alone is responsible for correctly declaring the goods as commercial merchandise at the border and paying all applicable customs duties and import VAT. Declaring goods as private travel baggage to avoid import charges is strictly prohibited and results in personal liability for the Carrier.
(5) Release of payment: When the Purchaser confirms receipt of the goods in the app, the purchase contract between Purchaser and Carrier is deemed fulfilled. The sum held in escrow via Stripe is paid out to the Carrier only after this confirmation (or after expiry of the claims period).
10. Final provisions
(1) The law of the Federal Republic of Germany applies. The place of jurisdiction is Munich.
(2) Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
(3) In the event of contradictions between different language versions, the German version shall prevail.
